Terms of Use

These Terms of Use (the “Terms”) set forth the conditions for using Jelly Swipe: Simple Color Merge Puzzle (“Jelly Swipe,” the “App,” or the “Service”) provided by Koh Kobayashi (“we,” “us,” or “our”).

By installing, launching, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

#1. Definitions

For the purposes of these Terms:

“User” or “you” means any individual who uses the App.

“App” means Jelly Swipe: Simple Color Merge Puzzle, including the smartphone game application, related features, content, advertisements, and any related services.

“Content” means all game content, images, sounds, music, designs, user interfaces, text, programs, data, scores, advertisements, and other information displayed, provided, generated, recorded, or used within the App.

“Game Data” means scores, progress, settings, play history, and other data generated through your use of the App, whether stored on your device or through third-party services.

“Third-Party Services” means services provided by third parties, including but not limited to the App Store, Google Play, advertising providers, analytics providers, operating system providers, and payment processors.

#2. Agreement to These Terms

You may use the App only after agreeing to these Terms and our Privacy Policy.

If you are a minor, you must obtain the consent of your parent or legal guardian before using the App.

If a minor uses the App, such use will be deemed to have been made with the consent of their parent or legal guardian.

Parents and legal guardians are responsible for appropriately managing minors’ use of the App, including advertisement viewing and use of third-party services.

#3. Changes to These Terms

We may modify these Terms when reasonably necessary, including due to changes in laws, changes to the App, operational needs, security reasons, or changes to third-party platform requirements.

When we modify these Terms, we will notify users of the revised Terms and their effective date by appropriate means, such as in-app notice, website posting, store listing, or other reasonable methods.

If you continue to use the App after the revised Terms take effect, you will be deemed to have agreed to the revised Terms.

If you do not agree to the revised Terms, you must stop using the App.

#4. License

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to use the App for your personal, non-commercial entertainment purposes.

This license does not transfer to you any ownership rights, copyrights, trademarks, or other intellectual property rights in or to the App or Content.

You must use the App in accordance with these Terms, applicable laws, the terms of the App Store or Google Play, and the terms of any applicable Third-Party Services.

Unless expressly permitted by us, you may not use the App for commercial purposes.

#5. Game Data and Device Use

The App may be used without account registration.

Game Data may be stored locally on your device or processed through Third-Party Services used by the App.

You are responsible for managing your own device, operating system settings, storage, backups, and network environment.

We do not guarantee that Game Data will always be saved, restored, transferred, or maintained.

We are not liable for loss of Game Data, failure to save scores, failure to restore settings, app deletion, device failure, OS updates, communication failures, or failures of Third-Party Services, except in cases of our intentional misconduct or gross negligence.

We may use Game Data, device information, usage information, and log information as necessary for providing, maintaining, improving, debugging, securing, and supporting the App. Personal information will be handled in accordance with our Privacy Policy.

#6. Advertisements and Rewarded Ads

The App may display advertisements, including but not limited to interstitial ads, rewarded ads, video ads, and other forms of advertising.

The App may use third-party advertising services, such as mobile advertising networks, to deliver advertisements.

Advertisements, advertiser services, and external websites or apps accessed through advertisements are governed by the terms and privacy policies of the relevant advertisers or third parties.

The App may offer in-game benefits through rewarded advertisements. However, rewarded ads may not always be available, and rewards may not be granted or may be delayed due to communication failures, lack of ad inventory, device settings, OS restrictions, advertising provider issues, fraud prevention measures, or other reasons.

We do not guarantee that advertisements will always be displayed, that a specific advertisement will be available, or that rewards will always be granted.

You must not engage in fraudulent ad viewing, invalid clicks, automated ad interactions, false installs, reward abuse, or any other misuse of advertising systems.

We do not guarantee the content, accuracy, legality, safety, or quality of advertiser products, services, websites, or apps.

We are not liable for any damages arising from advertisements or advertiser services, except in cases of our intentional misconduct or gross negligence.

#7. Advertising Identifiers and Tracking

The App may use advertising identifiers and related technologies for advertising, measurement, fraud prevention, and service improvement, as described in our Privacy Policy.

On iOS, the App may request permission through Apple’s App Tracking Transparency framework where required.

You may manage tracking, advertising, and privacy settings through your device settings or platform settings.

If you decline tracking permission or limit advertising identifiers, the App may still display advertisements, but they may be less personalized.

The handling of personal information, advertising identifiers, analytics data, and related information is described in our Privacy Policy.

#8. Paid Services and Purchases

The App currently does not provide paid services, subscriptions, in-app purchases, or paid items.

We may add paid features, subscriptions, ad removal, one-time purchases, in-game items, or other paid services in the future.

If paid services are introduced, the price, content, duration, renewal conditions, cancellation method, and refund conditions will be displayed in the App, on the applicable app store, or through the relevant payment processor.

Purchases, billing, cancellation, refunds, and payment method management through the App Store, Google Play, or other external payment services will be governed by the terms and procedures of the applicable platform or payment processor.

Purchases by minors must be made with the consent and supervision of their parent or legal guardian.

#9. Prohibited Conduct

You must not engage in any of the following acts or any acts that may fall under the following:

Violating laws, public order and morals, these Terms, store terms, or Third-Party Service terms.

Criminal acts, fraudulent acts, or acts that encourage them.

Exploiting bugs, errors, or unintended specifications of the App.

Cheating, modification, hacking, reverse engineering, decompiling, disassembling, source code analysis, data tampering, memory modification, score manipulation, or save data modification.

Using bots, scripts, macros, automation tools, scraping, crawlers, data mining, or other unauthorized methods to use, analyze, collect from, or operate the App.

Interfering with, overloading, bypassing, or compromising the App, advertisements, payment processing, authentication, security features, or Third-Party Services.

Unauthorized access, unauthorized use of another person’s device or account, impersonation, or transmission of false information.

Defaming, threatening, harassing, discriminating against, or otherwise harming other users, third parties, or us.

Infringing the personal information, privacy, portrait rights, reputation, credit, intellectual property rights, or other rights of others.

Sending, distributing, or introducing viruses, malware, or other harmful programs.

Selling, lending, transferring, sharing, exchanging, or commercially exploiting the App, Content, Game Data, scores, access rights, or paid services without our permission.

Unauthorized use of our or any third party’s trademarks, logos, images, sounds, music, designs, user interfaces, text, programs, or other intellectual property.

Using or analyzing the App for the purpose of creating identical or similar services, games, tools, cheats, analysis tools, or competing products.

False inquiries, false reports, excessive inquiries, or abuse of support channels.

Fraudulent ad viewing, invalid clicks, false installs, unauthorized reward acquisition, payment abuse, or refund abuse.

Any other act that we reasonably determine to be inappropriate from the perspective of service operation, user protection, security, or rights protection.

#10. Measures Against Violations

If we reasonably determine that you have violated or may violate these Terms, we may take necessary measures without prior notice, including warnings, restriction of features, deletion or correction of Game Data, invalidation of rewards, suspension of use, restriction of access, preservation of logs, reports to relevant third parties or authorities, and other appropriate measures.

We are not liable for any damages caused to you by such measures, except in cases of our intentional misconduct or gross negligence.

If your violation of these Terms causes damages to us or a third party, you may be liable for such damages to the extent permitted by law.

#11. Intellectual Property Rights

All copyrights, trademarks, design rights, know-how, other intellectual property rights, and ownership rights related to the App and Content belong to us or the rightful third-party owners.

You may not copy, reproduce, distribute, sell, lend, adapt, modify, publish, transmit, analyze, create derivative works from, or commercially use the App or Content beyond the scope permitted by these Terms.

You may use screenshots, gameplay videos, and similar materials from the App for non-commercial introductions, reviews, commentary, gameplay videos, or social media posts, provided that such use does not violate laws, public order and morals, our or any third party’s rights, mislead others, imply official approval by us, encourage cheating or unauthorized use, or otherwise constitute inappropriate use.

All rights not expressly granted to you under these Terms are reserved by us and the relevant rights holders.

#12. Third-Party Services and App Stores

The App may integrate with the App Store, Google Play, advertising services, analytics services, operating system services, payment services, and other Third-Party Services.

Your use of Third-Party Services is subject to the terms, privacy policies, guidelines, fees, age restrictions, and regional restrictions of the relevant Third-Party Services.

We are not liable for the content, continuity, accuracy, safety, legality, failures, specification changes, suspension, termination, data loss, account suspension, payment processing, or refund processing of Third-Party Services, except in cases of our intentional misconduct or gross negligence.

Due to specification changes, suspension, termination, failures, review requirements, or terms changes of Third-Party Services, all or part of the App may become unavailable.

#13. Changes, Suspension, and Termination of the App

We may change, add, suspend, interrupt, or terminate all or part of the App without prior notice when necessary, including for maintenance, bug fixes, security, legal compliance, operational reasons, business reasons, platform requirements, or Third-Party Service changes.

We may change the content, features, difficulty, game rules, design, rewards, advertisements, paid services, prices, regions, supported devices, and supported operating systems of the App.

We are not liable for any damages caused to you by changes, suspension, interruption, or termination under this Article, except in cases of our intentional misconduct or gross negligence.

#14. Updates

We may provide updates for the App for improvement, bug fixes, security enhancement, feature additions, legal compliance, and Third-Party Service compatibility.

If you do not install updates, all or part of the App may become unavailable.

Updates may change features, displays, game balance, data formats, storage methods, advertisements, and future paid services.

In connection with updates, device information, app version, usage information, logs, and similar information may be collected or processed. Personal information will be handled in accordance with our Privacy Policy.

#15. Privacy

We respect your privacy and handle personal information in accordance with applicable laws and our Privacy Policy.

Please refer to our Privacy Policy for information regarding the handling of personal information, device information, advertising identifiers, usage information, crash logs, analytics, advertising, purchase information, and inquiry information in connection with the App.

You should review and understand our Privacy Policy before using the App.

#16. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

We do not warrant that:

The App will be suitable for your specific purpose.

The App will always be accurate, complete, useful, or up to date.

The App will be free from interruptions, suspension, delays, errors, bugs, data loss, or security issues.

The App will operate properly on all devices, OS versions, browsers, communication environments, regions, or Third-Party Services.

Advertisements, rewarded ads, scores, settings, or external integrations will always function properly.

The App will be free of viruses or other harmful components.

The use of the App will produce any specific result, score, reward, profit, or satisfaction.

Game difficulty, random generation, scores, rewards, advertisements, and displayed content may be changed due to specification changes, bug fixes, or balance adjustments.

#17. Limitation of Liability

We are not liable for any damages arising from or in connection with the use of, or inability to use, the App, except in cases of our intentional misconduct or gross negligence.

Even where we are liable, our liability is limited to direct, ordinary, and actually incurred damages. To the extent permitted by law, we are not liable for lost profits, indirect damages, special damages, incidental damages, consequential damages, data loss, business damages, or emotional distress.

If we are liable in connection with future paid services, our liability will, to the extent permitted by law, be limited to the amount actually paid by you to us for the paid services that caused the damage during the one month immediately preceding the occurrence of the damage.

If we are liable in connection with free services, our liability will be limited to a reasonable amount to the extent permitted by law.

If consumer protection laws or other mandatory laws restrict the limitations in this Article, such limitations will not apply to the extent of such restriction.

The limitations of liability in this Article do not apply in cases of our intentional misconduct or gross negligence.

#18. User Responsibility and Indemnification

You are responsible for your use of the App, violations of these Terms, violations of laws, infringement of third-party rights, misconduct, purchases, and use of Third-Party Services.

If damages, costs, claims, or disputes arise against us or a third party due to your intentional or negligent acts, violation of these Terms, violation of laws, or infringement of third-party rights, you must compensate for such damages to the extent permitted by law.

If consumer protection laws or other mandatory laws invalidate or limit any excessive indemnification obligation imposed on you, this Article applies only to the extent permitted by such laws.

#19. Exclusion of Anti-Social Forces

You represent and warrant that you are not a member of an organized crime group, a member of such group, a person associated with such group, a corporate racketeer, or any other equivalent anti-social force.

You must not provide benefits to anti-social forces, lend your name to them, make threatening statements, make violent demands, make unreasonable demands, damage credibility, interfere with business, or engage in similar acts.

If you violate this Article, we may suspend your use of the App or take other necessary measures without prior notice.

#20. Assignment

You may not assign, transfer, pledge, or otherwise dispose of your status, rights, or obligations under these Terms to any third party without our prior written consent.

In the event of a business transfer, merger, business succession, change of operator, or similar transaction related to the App, we may assign or transfer our status, rights, obligations, Game Data, and user information to a third party in accordance with applicable laws and our Privacy Policy.

#21. Severability

If any provision or part of any provision of these Terms is held to be invalid, illegal, or unenforceable under law or by a court or other competent authority, the remaining provisions and the remaining parts of such provision will remain in full force and effect.

#22. No Waiver

Our failure or delay in exercising any right under these Terms will not be deemed a waiver of such right.

#23. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan.

Any dispute arising between you and us in connection with the App or these Terms will be subject to the exclusive jurisdiction of the Japanese court having jurisdiction over our location as the court of first instance, unless otherwise required by consumer protection laws or other mandatory laws.
